STEMBuddy Coding & Robotics Education owns and operates the website located at www.stembuddy.com.au (“website”). These terms of service implement to all users("users"). USERS:

• Enrolled and/or engage in a course
• Enrolled and/or engage in a course at centre or workshop
• Instructors
• Guide
• Parents/guardian/carer of students enrolled for a course
• Who upload/download any materials to the website
• Create content via the website
• Use services provided by this website or platform
• Just view the content on or accessible by this website.

By accepting this website or platform you indicate your/user agreement of these terms of service. If you do not accept these terms of service, then do not use this website's any content or services. These terms of service may be improved or updated by STEMBuddy Coding & Robotics Education from time to time without prior notice and the terms of service may have amended since your last visit to this website. It is user's liability to review these terms of service for any modifications. Your use after any revisions or updates of these terms of service shall imply your agreement to and acceptance of the before-mentioned revised terms. Any new features that may be added to this website and services from time to time will be subject to these terms of service unless declared otherwise. You must visit this link regularly, to review the terms of service of STEMBuddy Coding & Education. If you are accepting these terms of service on account of an organization or other entity, you represent and guarantee that you have the requisite rights and authority to access into these terms of service on behalf of such organization or entity and to bind such organization or entity to these terms of service.

If you are registering with us on account of childcare, daycare, kindergarten, school or school board and you require authorization from your institution to use the service and to provide us with personal information about students, you represent and guarantee that you have received such authorization and you accept to guarantee us for any losses or damages incurred as a result of your non-compliance.

To register for the service, you may be asked to produce “STEMBuddy Coding & Robotics Education for Children” with certain personal information, including personal information about your child or students (as applicable). All personal information will be managed per our privacy policy, the terms of which are herewith incorporated by reference into this contract. If you do not accept the terms of our privacy policy, do not use this website or the services or register a student for a “STEMBuddy Coding & Robotics Education for Children” course.

1. The Services

1. STEMBuddy Coding & Robotics Education conducts courses, centres, and workshops (“STEMBuddy Coding & Robotics Education for Children”) in Australia that teach children ages 5-17 how to write computer code via project-based learning. All “STEMBuddy Coding & Robotics Education for Children” courses are instructed by trained instructors (“instructors”) who have expertise working with children and who have undergone a work with children check.
2. STEMBuddy Coding & Robotics Education also makes available it's established a software-as-service platform that offers educational resources and electronic textbooks to subscribing organizations (the “platform”).

2. Course Registration

1. Centre/course student registration: If you are a parent/legal guardian registering your child (“student”) for a course, centre or workshop, you will be required to present the following information to register the student for a STEMBuddy Coding & Robotics Education course: your name, home phone number, mobile phone number, email address, mailing address, student’s name, age, and school. You will also be expected to select a location where your child will attend the STEMBuddy Coding & Robotics Education course from the list of locations on the registration page. If you are registering the student for a centre, you must register the dates the student will be attending, whether the student is attending a full or half-day centre, and your payment plan. If you are registering a student for one of the STEMBuddy Coding & Robotics Education weekly courses, you will be required to select the day of the week, time of the lesson, the date of the first class and your payment plan (see further details in the payments segment below).
2. School registration: If you are an institution (including childcare, daycare, kindergarten, schools, and districts) registering for a STEMBuddy Coding & Robotics Education course for your students, you will be required to collect the student registration information from students and/or their parents or legal guardians. You are solely responsible for obtaining consent from each student’s parent or legal guardian to (a) participate in a STEMBuddy Coding & Robotics Education course; and (b) collect, use and disclose students’ personal information by the STEMBuddy Coding & Robotics Education privacy policy.
3. Parental/ Guardian/ Carer Consent: When you register a student for a STEMBuddy Coding & Robotics Education course, you will also be required to present consent to our use of the student’s photograph and likeness by the STEMBuddy Coding & Robotics Education waiver and liability release form. You must consent to the terms of the disclaimer and liability statement form before the student will be permitted to initiate a STEMBuddy Coding & Robotics Education course.
4. All personal information obtained by STEMBuddy Coding & Robotics Education in the registration process or in providing any services, including personal information about students, will be managed by the terms of the STEMBuddy Coding & Robotics Education privacy policy, which you should read carefully. You hereby acknowledge that you have read and understood our privacy policy, and consent on your behalf and on behalf of each student you register for a STEMBuddy Coding & Robotics Education course, to our collection, use, and disclosure of personal information by the terms of our privacy policy.

3. Course Fee and Payments

1. Individual fees; payments: If you are a parent or legal guardian enrolling a student for a STEMBuddy Coding & Robotics Education course you can pay for the course by the website. The prices for the STEMBuddy Coding & Robotics Education courses are listed on centre registration pages, respectively. Centre fees are payable upfront in advance. Payments must be made by way of valid credit card, submitted to our third-party payment processor, PayPal. Please see our cancellation terms in section 16 below.
2. School, childcare, daycare, kindergarten payments, and invoices. If you are a school, childcare, day care, kindergarten registering for the services, STEMBuddy Coding & Robotics Education will invoice you directly. Schools, childcare, daycare, kindergarten are solely responsible for collecting from students and their parents or legal guardians, any fees associated with providing the STEMBuddy Coding & Robotics Education platform or publications to such students. Payments can be made using a valid credit card, cash or cheque.
3. GST: STEMBuddy Coding & Robotics Education are currently not registered for GST.

4. User Content

• Except for the website, platform, services, the curriculum content (as defined in segment 9 below), and any other materials provided to you by STEMBuddy Coding & Robotics Education for Children, all information, data, text, software, music, sound, photographs, graphics, video, messages or other materials, including student work outcome product (including projects, code, software, programming, assignment results, assessment and test results, and any other materials created by students), whether publicly posted or privately broadcasted to the website by users, or created or generated by students in course of participating in a STEMBuddy Coding & Robotics Education course (“user content”), is the sole liability of such users. This implies that the user, and not STEMBuddy Coding & Robotics Education for Children, is entirely responsible for all before-mentioned material uploaded, posted, emailed, transmitted or otherwise made available by participating in a STEMBuddy Coding & Robotics Education course and/or using the service. STEMBuddy Coding & Robotics Education does not regulate or actively control user content and, as such, does not guarantee the accuracy, integrity, or quality of the before-mentioned content. Under no conditions will STEMBuddy Coding & Robotics Education be liable in any way for any materials, including, but not limited to, for any errors or omissions in any materials, or for any loss or damage of any kind incurred as a result of viewing or using of any materials posted, emailed, transmitted or otherwise made available via the service.

5. Restrictions on user content and use of the service: STEMBuddy Coding & Robotics Education always holds the rights (but will have no obligation) to remove or refuse to share any user content and to terminate users or reclaim usernames. We also reserve the rights to access, read, preserve, and publish any information as we reasonably consider it necessary to

1. meet any applicable law, regulation, legal means or governmental request,
2. enforce these terms of service, including investigation of potential violations about,
3. detect, prevent, or unless address fraud, security or technical issues,
4. respond to user support inquiries, or
5. protect the rights, property or safety of our users and the public. In using the website or platform, engaging in a STEMBuddy Coding & Robotics Education course or otherwise using the services, you shall not and shall not authorize or encourage any other person to:
1. Copy any content unless expressly permitted to do so herein.
2. Upload, post, email, transmit or unless make available any material that:
   • Is unlawful, harmful, threatening, abusive, harassing, tortuous, defamatory, indecent, offensive, obscene, libellous, invasive of another's privacy, hateful, or racially or ethnically offensive, promotes criminal behaviour, gives surge to civil liability, violates any law, or is otherwise objectionable;
   • You do not have the authorization to make available under any law or a contractual connection
   • Violates any patent, trademark, trade code, copyright, or other proprietary rights of any party (including privacy rights);
   • Is or contains any unsolicited or unauthorized promotion, solicitations for business, promotional stuff, "junk mail," "spam," "chain letters," "pyramid schemes," or any other form of solicitation
   • Any other computer code, carries software viruses, data or programs designed to interfere, destroy or restrict the functionality of any telecommunications devices, computer software or hardware, data, the website or that of any viewers or users of the website/platform or that compromises a user’s privacy; or
   • Carries any untruths or misstatements or create an impression that you know is incorrect, misleading, or false, or any material that could damage or harm minors in any way.
3. Represent any person or entity or mislead their association with a person or entity.
4. Forge headers or otherwise manipulate identifiers to change the origin of any material transmitted to or through the website or represent another person or organization.
5. Intervene with or disrupt the website or platform or any servers or networks connected to the website or platform, or violate any conditions, procedures, policies or regulations of networks connected to the website or probe, scan, or test the vulnerability of any system or network or breach or bypass any security or authentication actions;
6. Intentionally or unintentionally violate any relevant local, state, national or international law or regulation.
7. Store or gather any personal provided data about other users or viewers.
8. License, sell, rent, lease, transfer, assign, distribute, host, or otherwise commercially misuse the website; or
9. Alter, translate, make derivative works of, disassemble, decompile, modify compile, or reverse engineer any section of the website or platform, except to the extent the foregoing restrictions are expressly forbidden by applicable law.

You also accept not to access the website or platform in a practice that utilizes the resources of the website or platform more densely than would be the case for an individual person using a standard web browser. Notwithstanding the foregoing, operators of public search engines may use spiders or other bots to create publicly available searchable files of the materials on this website or platform.

6. The license of user content

• By submitting, posting or displaying user content on or through the platform, you give us (and our agents) a non-exclusive, royalty-free license (with the right to sublicense) to apply, copy, modify, transmit, display and dispense such user content. STEMBuddy Coding & Robotics Education will not be accountable or liable for any use of user content by these terms. You represent and guarantee that you have all the rights, power, and authority needed to grant the rights granted herein to any user content that you submit.

7. End-user license

• Except for user content and curriculum content (defined below and subject to the license terms outlined in segment (9), this website and the platform, as well as the information and materials that it carries, are the property of STEMBuddy Coding & Robotics Education and its licensors and are preserved from unauthorized copying and dissemination via copyright law, trademark law, and other intellectual property laws. Subject to the terms of this contract, STEMBuddy Coding & Robotics Education grants you a non-transferable, nonexclusive, license to use the website and content contained therein for your classroom use (the “end user license”).  Nothing in the terms gives you a right to use the STEMBuddy Coding & Robotics Education or STEMBuddy Coding & Robotics Education names, trademarks, logos, domain names, and other notable brand features without our prior written permission. You shall not attempt to override or bypass any of the usage rules or restrictions on the website or platform. Any future announcement, update, or other extensions to the functionality of the website or platform shall be subject to the terms of this contract.

8. Curriculum Content License

• STEMBuddy Coding & Robotics Education offers students access to curriculum content for STEMBuddy Coding & Robotics Education courses that are the property of STEMBuddy Coding & Robotics Education and its licensors, including without restriction, lesson plans, assignments, course materials, tests, assignments, worksheets, online course materials, projects and project plans and other content and materials connected with the same (“curriculum content”). The curriculum content is preserved by copyright and protected by law from unauthorized copying and dissemination. Subject to the terms of this agreement and the payment of any applicable fees, STEMBuddy Coding & Robotics Education a wards to students a non-transferable, non-exclusive, license to access, use and copy the curriculum content (the “curriculum content license”) solely to the extent necessary to participate in, and complete, the STEMBuddy Coding & Robotics Education courses.

9. Curriculum Content Restrictions

• In accessing and using the website, platform, and curriculum content, participating in a STEMBuddy Coding & Robotics Education course, and/or otherwise using the service, you shall not:
  1. Share, lease, rent, assign or otherwise transfer any of the curriculum content to any third party without the prior written permission of STEMBuddy Coding & Robotics Education
  2. Discard any proprietary notices, labels or marks from the curriculum content or change, alter or damage any of the trademarks, service marks or other intellectual property made accessible as part of the curriculum content in any manner, or use any of the foregoing except for the particular purpose for which such intellectual property is made available to you;
  3. Bundle the content of the curriculum in another product for resale, or generally use the curriculum content for any other commercial purposes without the prior express written consent of STEMBuddy Coding & Robotics Education
  4. Make copied products or materials or resources from the curriculum content; or
  5. Utilize the curriculum content to develop or derive consulting or other programs,
  6. Educational materials or services that are similar or and/or competing with the STEMBuddy Coding & Robotics Education courses and services provided by STEMBuddy Coding & Robotics Education for Children.

10. Feedback

• If you produce STEMBuddy Coding & Robotics Education with any advice, comments or other feedback relating to any aspect of the website, platform or the STEMBuddy Coding & Robotics Education courses ("feedback"), STEMBuddy Coding & Robotics Education may use such advice, comments or feedback in the website or any other STEMBuddy Coding & Robotics Education products or services (collectively, "STEMBuddy Coding & Robotics Education offerings"). Accordingly, you consent that:
  1. STEMBuddy Coding & Robotics Education is not subject to any confidentiality obligations regarding the feedback,
  2. The feedback is not confidential or proprietary information of you or any third party and you have all of the necessary rights to disclose the feedback to STEMBuddy Coding & Robotics Education for Children,
  3. STEMBuddy Coding & Robotics Education(including all of its followers and assigns and any followers and assigns of any of the STEMBuddy Coding & Robotics Education offerings) may freely use, reproduce, publicize, license, distribute, and otherwise commercialize feedback in any STEMBuddy Coding & Robotics Education offerings, and
  4. You are not authorized to receive any compensation or reimbursement of any kind from STEMBuddy Coding & Robotics Education or any of the other users of the website in regard of the feedback.

11. Disclaimer of representations, warranties and conditions

• The website, platform, curriculum content and all materials provided there, including the curriculum content, are provided "as is." we do not guarantee or make any representations or warranties of any special result or outcome as a result of registering a student for a course or otherwise using the services. Student achievement in completing a STEMBuddy Coding & Robotics Education course will depend on a difference of circumstances including student’s regular attendance, enthusiasm, and timely completion of assignments, among other things STEMBuddy Coding & Robotics Education specifically disclaims all representations, warranties and conditions, either express, implied, lawful, by the usage of trade, course of dealing or otherwise incorporating but not limited to any implied warranties of merchantability, non-infringement, title, satisfactory quality or suitability for a particular purpose. Any information or material downloaded or obtained by the use of the service, including curriculum content, is at your responsibility and risk and you will be solely responsible for any damage to your computer system, loss of data, or any other loss that results from downloading or using any such material. STEMBuddy Coding & Robotics Education does not warrant, support, guarantee, give any conditions or representations, or consider any responsibility for any product or service advertised or given by any third party through the website or in respect to any website that can be reached from a link on the website or featured in any banner or other promotion on the website, and STEMBuddy Coding & Robotics Education shall not be a party to any transaction that you may enter into with any such third party. STEMBuddy Coding & Robotics Education will not be responsible for any type of content exchanged using the service or for any communications or transactions between users.
• STEMBuddy Coding & Robotics Education, Australia reserves the right to do the following, at any time, without notice:
  1. Upgrade technology, study material, lessons and curriculum for coding & robotics workshops or classes;
  2. For any reason, suspend or terminate operation of or access to the Website, or any portion of the website;
  3. Modify or change the Website, or any portion of the Website, including prices, and any applicable policies or terms; and
  4. To interrupt the operation of the Website, or any portion of the Website, as necessary to perform routine or non-routine maintenance, to resolve errors, or other minor or major upgrades or changes.

12. Limitation of liability

• Under no conditions shall STEMBuddy Coding & Robotics Education be responsible for any direct, indirect, incidental, special, consequential, exemplary or other damages whatsoever, including, without limitation, any damages that result from
  1. your use of or your failure to use this website or the service,
  2. the cost of procurement of substitute goods, data, information or services
  3. errors, mistakes, or inaccuracies in the materials on the website
  4. personal injury or property damage of any kind whatsoever resulting from or linking to your use of the service, any bugs, viruses, trojan horses, or any other files or data that may be harmful to computer or communication equipment or data that may have been transmitted to or by the website
  5. any errors or omissions in any material on the website or any other loss or harm of any kind arising from or linking to your use of the website; or
  6. any losses incurred as a result of student’s participation in a STEMBuddy Coding & Robotics Education course (including without limitation, losses arising due to student’s failure to attend, participate in or complete the STEMBuddy Coding & Robotics Education course and course work), unless such losses are directly attributable to STEMBuddy Coding & Robotics Education’s negligence.

These conditions shall apply even if STEMBuddy Coding & Robotics Education has been notified of the possibility of such damages.

Notwithstanding anything to the contrary included herein, STEMBuddy Coding & Robotics Education’s liability to you for any damages resulting from or linked to this contract (for any reason whatsoever and regardless of the form of the action), will at all times be restricted to the greater of (a) sixty Australian dollar (AUD 60) or (b) amounts you’ve paid STEMBuddy Coding & Robotics Education for the particular STEMBuddy Coding & Robotics Education course the student was engaging in at the time the loss arose. The foregoing limitations shall apply to the fullest extension authorized by law in the relevant jurisdiction.

13. Indemnification

• You shall indemnify and hold STEMBuddy Coding & Robotics Education and its subsidiaries, affiliates, officers, agents, and employees, harmless from all claims, actions, proceedings, damages, losses, costs, demands and costs (including reasonable attorneys' fees), acquired in connection with:
  1. any materials submitted, posted, transmitted or made available by you or your child through the service.
  2. any communications or transactions between you and any other user or between your child and any other student or user; and/or
  3. any breach by you of these terms of service, the rights of any third party or any applicable law or regulation of the state.
     

14. Termination

• You shall indemnify and hold STEMBuddy Coding & Robotics Education and its subsidiaries, affiliates, officers, agents, and employees, harmless from all claims, actions, proceedings, damages, losses, costs, demands and costs (including reasonable attorneys' fees), acquired in connection with:
  1. By STEMBuddy Coding & Robotics Education for Children. STEMBuddy Coding & Robotics Education may, under certain conditions and without prior notification, immediately terminate your eligibility to access the website, platform, curriculum content, services, or portions thereof. Reason for such termination shall include, but not be limited to,
     1. breaches or violations of these terms of service or any other contract that you may have with STEMBuddy Coding & Robotics Education(including, without limitation, non-payment of any fees owed in connection with the website or otherwise owed by you to STEMBuddy Coding & Robotics Education and misuse or misappropriation of the curriculum content),
     2. offers by law enforcement or other government agencies,
     3. a request by you,
     4. discontinuance or material alteration to the website and services (or any part thereof),
     5. unexpected technical, security or legal issues or problems, and/or
     6. participation by you, directly or indirectly, in fraudulent or illegal activities.

     Termination of your access to the website may also include the removal of some or all of the materials uploaded by you to the website. You acknowledge and accept that all terminations may be made by STEMBuddy Coding & Robotics Education in its sole discretion and that STEMBuddy Coding & Robotics Education shall not be responsible to you or any third-party for any termination of your access to this website or the removal of any of the materials uploaded by you to the website. Any termination of these terms of service by STEMBuddy Coding & Robotics Education shall be in addition to all other rights and remedies that STEMBuddy Coding & Robotics Education may have.

  2. STEMBuddy Coding & Robotics Education courses. If you obtained a discount on STEMBuddy Coding & Robotics Education course fees for signing up for a minimum term and you cancel your registration before the end of such term, you will be charged the difference between the regular STEMBuddy Coding & Robotics Education course price and the discount price for any STEMBuddy Coding & Robotics Education courses enrolled.

15. Availability & updates

• STEMBuddy Coding & Robotics Education may modify, suspend, or terminate this website at any time and for any reason or no reason, without prior notice. The website may be unavailable from time to time due to maintenance or malfunction of the computer or network devices or other reasons. STEMBuddy Coding & Robotics Education may periodically add or update the information and materials on this website without prior notice.

16. Cancellation and refunds

• We cover the first 25km in each direction from the Narre Warren, VIC. After that we charge a minimum amount to cover fuel & toll. Please call us to get a quote specific to your needs.

17. Travel

• – Cancellations requests 29 to 42 days (4 to 6 weeks) prior to the incursion will be charged at 50% of total invoice amount
• – Cancellations requests 15 to 28 days (2 to 4 weeks) prior to the incursion will be charged at 75% of total invoice amount
• – Cancellation requests 14 days (2 weeks) or less prior to the incursion will be charged at the full invoiced amount.
• All cancellations must be in writing. Please follow up if you have not received acknowledgement within 2 business days.

18. Security

• Information sent or received over the internet is generally not secure and STEMBuddy Coding & Robotics Education cannot and does not make any representation or warranty concerning security of any transmission to or from the website or any representation or warranty concerning the interference by third parties of personal or other information. You are responsible for safeguarding the password that you use to access the service and you are liable for any activities or actions under your password. You agree to keep your password secure. STEMBuddy Coding & Robotics Education will not be liable for any loss or damage arising from your failure to comply with these requirements.

19. General

• These terms of service, together with our privacy policy and any other policy referenced herein, constitute the entire agreement between the parties linking to the website, platform, and services and all related activities, including participating in a STEMBuddy Coding & Robotics Education course. These terms of service shall not be altered except in writing signed by both parties or by a new posting of these terms of service issued by STEMBuddy Coding & Robotics Education for Children. If any part of these terms of service is held to be unlawful, void, or unenforceable, that part shall be considered severed and shall not affect the legality and enforceability of the remaining terms. The failure of STEMBuddy Coding & Robotics Education to exercise or implement any right or provision under these terms of service shall not constitute a waiver of such right or provision. Any waiver of any right or provision by STEMBuddy Coding & Robotics Education must be in writing and shall only apply to the specific situation identified in such writing. You may not assign the terms of service, or any rights or licenses granted hereunder, whether voluntarily, by operation of law, or otherwise without STEMBuddy Coding & Robotics Education’s prior written permission. We may allow these terms of service without limitation. These terms of service are governed by the laws of the state of Victoria without regard to its choice of laws of the state. You hereby irrevocably attorn to the exclusive jurisdiction of the courts of the state of Victoria. • We use licensed products of LEGO, DUPLO, EV3, WeDo 2.0, Scratch, Scratch Jr., Micro:Bit, Blue-Bot, DJI, HP during our training sessions and these products are not manufactured, produced by STEMBuddy Coding & Robotics Education in any terms. LEGO are registered trademarks of the LEGO group of companies which does not sponsor, authorise or endorse these programs or this website. BlueBot, EV3, WeDo 2.0, Scratch, Micro:Bit, DJI are registered trademark of its respective manufacturing companies, it doesn't belongs to STEMBuddy Coding & Robotics Education, Australia. Our programs outcomes are linked to Victorian Curriculum (F-10) expected outcomes and we are following what is written on Victorian Curriculum website, and Victorian Curriculum (F-10) and a it's logo belongs to Victorian Curriculum and Assessment Authority (https://victoriancurriculum.vcaa.vic.edu.au/) and doesn't belongs to STEMBuddy coding & Robotics Education.
